Chamber of Commerce and VAT identifiers must be completed on invoices where registration exists; request formal invoice data at order time if required for your records.
2. Application
By placing an order you declare that you accept these Terms and the Privacy Policy. If you do not agree, do not complete a purchase. We may update these Terms; the version applicable is the version published at the time you submit your order unless mandatory law provides otherwise.
3. Products and information
Phytovitalyx is offered as a food supplement. Product pages contain descriptive information. Images are illustrative; minor packaging changes may occur when suppliers update materials. Labelling on the physical product prevails over website text where discrepancies arise.
Food supplements are not medicines and are not presented as substitutes for medical treatment. Keep products away from children. Follow the label unless a healthcare professional gives different guidance appropriate to your situation.
4. Price and taxes
Prices are shown in euros including VAT at the rate applicable in the Netherlands for consumer sales unless stated otherwise. Delivery costs appear before checkout confirmation. We may correct obvious price errors before acceptance; if an error could reasonably have been recognised as such, we may cancel the order and refund payments received.
5. Formation of contract
Product presentation constitutes an invitation to treat. Your order is an offer. We confirm acceptance by an order confirmation email or by dispatching the goods, whichever occurs first. We may decline orders tied to fraud risk, stock unavailability, or legal restrictions.
6. Payment
Payment methods appear at checkout. We do not store full card numbers on our servers when payments are handled by certified payment service providers. You warrant that you are authorised to use the chosen payment method.
7. Delivery
Delivery periods communicated on the site are estimates. Risk of loss transfers to you upon delivery to the address provided or a collection point according to carrier terms. Inspect parcels on receipt and document damage with the carrier where external damage is visible.
8. Right of withdrawal for consumers
Consumers within the meaning of EU consumer law generally have a fourteen-day right of withdrawal for distance contracts. Exceptions may apply to sealed goods unsuitable for return due to health protection or hygiene if opened after delivery, when such goods are applicable. Exercise your right by clear notice within the withdrawal period. See the Return Policy for practical steps, return costs, and refund timing.
9. Legal guarantee
Consumers benefit from the legal conformity guarantee under applicable Dutch and EU rules. Commercial buyers receive remedies as defined in the Civil Code subject to agreed limitations where permitted. Claims require timely notification after discovery of a defect.
10. Liability
Nothing in these Terms excludes liability that cannot be excluded under mandatory law. Subject to mandatory limits, our aggregate liability for direct damages arising from a given order is limited to the amount paid for that order unless caused by intent or gross negligence.
We are not liable for indirect losses such as lost profits except where mandatory law states otherwise. We are not responsible for failures caused by force majeure events including strikes, transport disruptions, public health measures, or infrastructure outages beyond reasonable control.
11. Intellectual property
Trademarks, product descriptions, layout, and media on this website are protected. You may not copy, scrape, or reuse them for commercial purposes without written consent, except as allowed by limited private copying or quotation rules.
12. Privacy and communications
Processing of personal data is described in the Privacy Policy. Service emails related to your order may be sent without separate marketing consent. Marketing messages require appropriate consent or another valid basis.
13. Complaints and dispute resolution
Contact customer service first to resolve issues. Consumers may use the European Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr. Participation in alternative dispute resolution before a specific body is voluntary unless we state otherwise.
14. Governing law and jurisdiction
These Terms are governed by the laws of the Netherlands, excluding conflict-of-law rules that would refer to another system. Mandatory consumer protections in your country of residence remain available where such rules apply. The courts of Amsterdam have jurisdiction for business customers unless mandatory law assigns another forum for consumers.
15. Severability
If a provision is invalid, the remainder stays in effect and a valid substitute closest to the intent applies where possible.
